Since 1987 individuals have had the ability to contract-out of the State Earnings Related Pension Scheme, which changed to State Second Tier Pension. This built up money within a Personal Pension, which is known as Protected Rights.

In return for a lower state pension, the investor receives a rebate of their National Insurance payments which is paid into their pension scheme. These payments, and the growth on them, are fenced off as protected rights.
